Solicitors Certificates:
When entering into a loan such as a mortgage as a Mortgage, either as a Borrower or a Guarantor, Lenders may require the loan documents to be witnessed by a solicitor and to provide a solicitor certificate. Frequently, individuals approach solicitors with a view to have the solicitor certificate to be signed and are upset when told that the process requires more than simply a signature.
A Solicitor’s Certificate is a document which certifies to a Lender that a solicitor has gone over the documents with a Borrower (or Guarantor) and that the Borrower understands the contents of the documents and their import. In the event that a Borrower later defaults or otherwise tries to avoid the loan by claiming that they did not understand something contained in the documents, either the Borrower or the Lender can sue the Solicitor who provided the certificate.
It is therefore our standard procedure to review the documents referred to in the Solicitor Certificate, meet with the Borrower/Guarantor and provide a letter of advice which explains how the documents are structured to place the lender in the best possible position of recovering the loan funds. We also retain a signed copy of the advice on file.
